End User License Agreement (EULA) for "Sam's Journal"

1. License Grant

"Sam's Journal" ("the App") grants you ("the User") a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal, non-commercial purposes only. The App is licensed, not sold, to you.

You may install and use the App on a single Android device that you own or control. This license does not permit you to:

  • Use the App for commercial purposes
  • Remove or alter any proprietary notices from the App

This license remains in effect until terminated by you or the developer. Your rights under this license will terminate automatically if you fail to comply with any of its terms.

2. Privacy Statement

The App functions solely in an offline capacity and does not establish any network connections or transmit data externally under normal operation. All journal entries and associated data are stored exclusively on the User’s device and are neither collected, transmitted, nor sold by the developer at any time.

However, you acknowledge that certain actions you take—such as device backups, syncing with cloud services, and certain microphone or keyboard configurations—may result in your journal data being transferred outside the App. You are solely responsible for the security and privacy of your data.

3. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

4. Limitation of Liability

To the fullest extent permitted by law, the developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the User's use of or inability to use the App, including but not limited to loss of data or damage to the User's device.

5. Health Disclaimer

The App is a prompted journal designed for personal reflection and does not provide medical, psychological, or health advice. The App’s effects on mental or physical health have not been evaluated or approved by any regulatory or governing body. Users should seek professional advice for health-related concerns.

6. Modifications and Termination

The developer reserves the right to modify or discontinue the App at any time without notice. The license to use the App will automatically terminate if the User fails to comply with any of the terms of this Agreement.

7. Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the parties’ original intent.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States of America.
